1. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

2. Eligibility and Age Restriction

The Service is intended for users who are at least 13 years of age. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Intellectual Property Rights

Our Service allows you and other users to create unique content. We and our users each retain rights to our respective content as described below.

3.1. Our Intellectual Property

The Service and its original content, including but not limited to the name rockslide.ai™, logos, text, graphics, user interface, and the underlying code and models, are owned by Elsanis LLC or their respective licensors. Third-party open-source software and model components remain subject to their own licenses. Our trademarks may not be used without our prior written consent.

3.2. User-Submitted Content

You may provide input to the Service, including lyrics, text prompts, and queries ("User-Submitted Content"). You retain any ownership rights you have in your User-Submitted Content. By submitting content, you grant Elsanis LLC a non-exclusive permission to process, copy and store it as needed to generate and deliver your requested song, provide support, prevent abuse and meet legal obligations. This permission does not authorize public broadcast of private submissions or training our models on them.

3.3. Service-generated songs and commercial use

Elsanis LLC grants you a worldwide, perpetual, non-exclusive, royalty-free permission to use, copy, edit, distribute, publicly perform, and commercially exploit the songs you generate and download through Rockslide.ai. This includes monetized videos, podcasts, games, advertisements, and client projects. It applies to free-credit and paid-credit songs, survives account closure, and requires no additional license fee, royalties to Elsanis LLC, or attribution to Rockslide.ai.

Our permission is not third-party permission or clearance. The license or permission we grant covers only rights Elsanis LLC has authority to grant. It does not grant a license, consent, release, or other authorization from any third party, whether material is supplied by you or appears in Service-Generated Content. Third-party rights may include copyrights, trademarks, rights in recordings, privacy rights, rights of publicity, and rights in a person's name, voice, or likeness. You are responsible for obtaining any third-party permissions your intended use requires.

No assurance against third-party claims. To the fullest extent permitted by applicable law, Elsanis LLC makes no representation or warranty that Service-Generated Content, or your possession, publication, distribution, performance, commercial exploitation, or other use of it, will not infringe, misappropriate, defame, or otherwise violate any third party's rights. We do not represent or warrant that you will not receive a complaint, demand, takedown notice, claim, or lawsuit, including allegations of copyright or trademark infringement, libel or other defamation, invasion of privacy, violation of rights of publicity, or other alleged wrongdoing, whether or not an allegation ultimately has merit. Our permission to use a song is not a legal clearance or a guarantee against such allegations. AI-generated material may not qualify for copyright protection; we do not promise exclusive ownership or uniqueness.

To the extent any rights arise and you hold them under applicable law, you retain your rights in the audio, visual, and written content you create using the Service ("Service-Generated Content"). We do not promise that AI-generated content is copyrightable, unique, exclusive, or cleared of third-party rights. Permission to use our models does not itself grant rights in someone else's lyrics, recordings, trademarks, likeness or voice. You are responsible for the content you create and for ensuring it does not violate the rights of any third party. You grant Elsanis LLC permission to process, store and deliver Service-Generated Content for those service purposes. If you separately opt in to Rocky’s show, you also grant a non-exclusive, worldwide, royalty-free permission to review, introduce, broadcast and retain the selected song and submitted on-air details in the public radio archive for replay. You may request withdrawal from future selection before broadcast, but an aired broadcast cannot be recalled. We do not currently train our own models on customer submissions or outputs.

4. User Conduct and Acceptable Use

4.1. Model-use restrictions

As a binding condition of generating content, you must comply with the Gemma Terms of Use and the use restrictions in Section 3.2, including the Gemma Prohibited Use Policy, which are incorporated into these Terms. This applies when Gemma functionality is provided through this website or API. You must not submit instructions or use outputs for uses prohibited by those restrictions. A violation is a violation of these Terms and may result in rejection, suspension or termination of access. A local copy of the Gemma agreement and use policy are available. If the upstream model terms change, updated applicable conditions will be identified before requiring renewed acceptance.

You must have permission to submit lyrics, recordings, names, likenesses or other protected material. Do not request copied song lyrics, artist or voice impersonation, unlawful or infringing content, harassment, scams, or instructions to bypass safety checks. Model-specific licenses and notices are listed on our Licenses & Notices page.

4.2. Radio and fictional host

Radio songs, DJ speech and host imagery may be generated using AI. Rocky is a fictional host. Song lyrics and her commentary are creative entertainment and may contain mistakes; consult the linked sources for reporting. Submitting or generating a song does not automatically guarantee radio placement. Song download credits purchase downloadable music, not a guaranteed airtime or paid radio placement. Show submission is optional and subject to review.

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. You agree not to create content that is illegal, defamatory, obscene, pornographic, abusive, promotes violence or hatred, targets or harasses individuals or groups, or infringes upon the intellectual property or other rights of any third party. We reserve the right to block access for violations of these terms.

5. Copyright Infringement (DMCA Policy)

We respect the intellectual property rights of others. If you believe that any content on the Service infringes upon your copyright, please submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the information required by the DMCA in writing. 6. Disclaimer of Warranties

The Service and Service-Generated Content are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, Elsanis LLC disclaims all representations and warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that Service-Generated Content will be accurate, complete, reliable, or meet your specific requirements.

We make no representation or warranty that an output or its use is cleared of third-party rights or will be free of third-party allegations, demands, takedowns, claims, or litigation. This includes allegations concerning copyright, trademark, libel or other defamation, privacy, rights of publicity, names, voices, likenesses, or other rights, even if an allegation is ultimately unfounded. These disclaimers do not withdraw the permission expressly granted in Section 3.3 and do not exclude or limit rights or protections that cannot lawfully be excluded or limited.

7. Limitation of Liability

To the fullest extent permitted by law, in no event shall Elsanis LLC, its members, affiliates, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.

8. Indemnification

You agree to defend, indemnify, and hold harmless Elsanis LLC and its members from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use of the Service or your breach of these Terms.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Westchester County, New York to resolve any legal matter arising from these Terms.

10. Dispute Resolution by Binding Arbitration

You and Elsanis LLC agree that any dispute, claim, or controversy arising out of these Terms or the use of the Services will be resolved by binding arbitration, except that each party retains the right to bring an individual action in small claims court and to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent infringement of intellectual property rights. YOU AND ELSANIS LLC WAIVE THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

11. General Provisions

11.1. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the most current version on our site. By continuing to use the Service after revisions become effective, you agree to be bound by the revised terms.

11.2. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach the Terms.

11.3. Entire Agreement

These Terms constitute the entire agreement between you and Elsanis LLC regarding our Service.
